This Privacy Policy, which is incorporated into and subject to our Terms of Use, describes the information that we gather from you, how we use and disclose that information, and the steps we take to protect it.

Information We Collect on the Services

User Provided Information

When you use the Services, we may collect information about you, including your name, email address, date of birth, gender, height, weight, language preferences, basketball profile information, training goals, workout preferences, team status, skill level, and other information you choose to provide to us. You may provide us with information in various ways on the Services, including when you register for an account, complete onboarding, use the Services, subscribe to paid features, contact support, or otherwise interact with the Services.

We may also collect workout related information you create through the Services, including workout sessions, performance statistics, goals, achievements, progress history, coaching feedback, and optional photos or content you choose to upload.

Automatically Collected Information

When you use the Services, we may automatically collect certain information from your device and your use of the Services, such as your device type, operating system, app version, unique device identifiers, language, time zone, IP address, crash and diagnostic data, feature usage, session dates and times, and other information regarding how you interact with the Services.

Camera, Audio, and Workout Information

The Services use camera, audio, and workout related inputs to provide real time coaching, workout analysis, and progress tracking. This may include basketball movement and shot activity, workout duration, session level performance data, and voice interactions you initiate through the app.

We do not store raw camera footage on our servers. Audio and workout related information may be processed to provide coaching, answer user questions, improve the Services, and support user progress over time.

Subscription Information

If you subscribe to paid features, purchases are processed through Apple’s App Store. We may receive information related to your subscription status, trial status, entitlement status, renewal or expiration dates, and similar purchase related information. We do not receive your payment card details.

How We Use the Information We Collect

We use information we collect on the Services in a variety of ways in providing the Services and operating our business, including the following:

    •    to operate, maintain, enhance, and provide the Services

    •    to create and manage user accounts

    •    to personalize workouts, coaching, and progress tracking

    •    to generate real time and post workout feedback

    •    to analyze usage trends and improve product performance

    •    to develop new products, services, features, and functionality

    •    to respond to comments, questions, and customer service requests

    •    to verify subscription status and provide paid features

    •    to send service related notices, updates, security alerts, and administrative messages

    •    to send promotional communications where permitted by law

    •    to protect our rights, users, and the integrity of the Services

    •    to comply with legal obligations

We may also use aggregated or de identified information for analytics, research, product improvement, and business purposes.

We do not sell your personal information. We do not share your personal information for cross context behavioral advertising.

We may also disclose aggregated, automatically collected, or otherwise non personal information for reporting, analytics, business, or marketing purposes.

Your Choices

You may decline to share certain information with us, in which case we may not be able to provide some features of the Services.

You may access, update, or delete certain information through the app. You may also request access to, correction of, or deletion of personal information we hold about you by contacting us at mailto:support@trainifylabs.ai.

You may delete your account through the app. If you do so, we will delete or de identify your information in accordance with applicable law, subject to any information we are required or permitted to retain for legal, security, accounting, or legitimate business purposes.

If you receive promotional emails from us, you may opt out by following the unsubscribe instructions in those emails. Even if you opt out of promotional messages, you may still receive administrative or service related communications from us.

If you are a California resident, you may have additional rights under California law, including rights to know, access, correct, or delete certain personal information. Trainify does not sell personal information and does not share personal information for cross context behavioral advertising.

Third Party Services

The Services may contain features or links to websites, products, or services provided by third parties, and the Services may be made available through third party platforms such as Apple’s App Store. Any information you provide to third parties is subject to their own privacy policies and practices. We are not responsible for the content, privacy, or security practices of such third parties, and we encourage you to review their policies before providing them with information.

Children’s Privacy

Protecting the privacy of children is especially important. The Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us at mailto:support@trainifylabs.ai and we will take appropriate steps to delete the information.

If you are between 13 and the age of majority in your jurisdiction, you may use the Services only with the involvement of a parent or legal guardian where required by law.

Data Security

We use commercially reasonable physical, technical, and organizational safeguards designed to protect the information we collect and maintain. However, no security system is impenetrable, and we cannot guarantee the absolute security of your information.

International Transfer

Trainify Labs Inc is based in the United States. If you use the Services from outside the United States, your information may be transferred to, stored, and processed in the United States or other jurisdictions where our service providers operate. By using the Services, you understand and agree to such transfer, storage, and processing, subject to applicable law. Your current draft already states Trainify is based in the United States and that data may be transferred and processed there.

Changes and Updates to this Policy

We may update this Privacy Policy from time to time. If we make changes, we will post the updated Privacy Policy and revise the “Last revised” date above. In some cases, we may also provide additional notice, such as through the Services or by email.
